18 Section 5. Section 316.2127, Florida Statutes, is
19 created to read:
20 316.2127 Operation of utility vehicles and golf carts
21 on certain roadways by homeowners associations for maintenance
22 purposes.--
23 (1) For general maintenance, security, and landscaping
24 purposes, a utility vehicle or golf cart as defined in s.
25 320.01, may be operated by a homeowners' association, as
26 defined in s. 720.01, or its agents, upon any county road or
27 city street within the area controlled or maintained by the
28 association.

1 defined in s. 720.01, or its agents, on a part of the State
2 Highway System only under the following conditions:
3 (a) To cross a portion of the State Highway System
4 which intersects a county road or a city street within an area
5 controlled or maintained by the association.
6 (b) To cross, at midblock, a part of the State Highway
7 System where the highway bisects property controlled or
8 maintained by a homeowners' association.
9 (c) The Department of Transportation has reviewed and
10 approved the use of that portion of the State Highway System
11 by utility vehicles or golf carts.
12 (3) A utility vehicle or golf cart may be operated on
13 public roads or streets pursuant to this section only under
14 the following conditions:
15 (a) The association or its agents may operate the
16 utility vehicle or golf cart only during hours between sunrise
17 and sunset.
18 (b) The utility vehicle or golf cart must be equipped
19 with efficient brakes, a reliable steering apparatus, safe
20 tires, a rearview mirror, and red reflectorized warning
21 devices in both the front and the rear.
22 (c) The utility vehicle or golf cart may not be
23 operated on public roads or streets by any person under the
24 age of 14.
25 (4) A violation of this section is a noncriminal
26 traffic infraction, punishable pursuant to chapter 318 as
27 either a moving violation for infractions of subsection (1),
28 subsection (2), or paragraph (a) of subsection (3), or as a
29 nonmoving violation for infractions of paragraphs (b) or (c)
30 of subsection (3).
