13         Amendment (with title amendment) 

14         On page 13, between lines 29 and 30,

16  insert:

17         Section 8.  Subsection (2) of section 316.304, Florida

18  Statutes, is amended to read:

19         316.304 Wearing of headsets.--

20         (2)  This section does not apply to:

21         (a)  Any law enforcement officer equipped with any

22  communication device necessary in performing his or her

23  assigned duties or to any emergency vehicle operator equipped

24  with any ear protection device.

25         (b)  Any applicant for a license to operate a

26  motorcycle while taking the examination required by s.

27  322.12(5).

28         (c)  Any person operating a motorcycle who is using a

29  headset that is installed in a helmet and worn so as to

30  prevent the speakers from making direct contact with the

31  user's ears so that the user can hear surrounding sounds.

  1         (d)  Any person using a headset in conjunction with a

  2  cellular telephone that only provides sound through one ear

  3  and allows surrounding sounds to be hear with the other ear.

  4         (e)  Any person using a headset in conjunction with

  5  communicating with the central base operation that only

  6  provides sound through one ear and allows surrounding sounds

  7  to be heard with the other ear.

12         On page 1, line 29, after the first semicolon,

15         amending s. 316.304, F.S.; revising

16         requirements regarding the wearing of headsets
