9 from public-records requirements for bank
10 account numbers or debit, charge, or credit
11 card numbers given to an agency for purposes of
12 payment of a fee or debt; providing an
13 effective date.

15 Be It Enacted by the Legislature of the State of Florida:

17 Section 1. Paragraph (ee) is added to subsection (3)
18 of section 119.07, Florida Statutes, as amended by section 1
19 of chapter 2001-364, Laws of Florida, to read:
20 119.07 Inspection, examination, and duplication of
21 records; exemptions.--
22 (3)
23 (ee) Bank account numbers and debit, charge, and
24 credit card numbers held by an agency are exempt from
25 subsection (1) and s. 24(a), Art. I of the State Constitution.
26 This exemption applies to bank account numbers and debit,
27 charge, and credit card numbers held by an agency before, on,
28 or after the effective date of this exemption.
29 Section 2. The Legislature finds that it is a public
30 necessity that bank account numbers and debit, charge, and
31 credit card numbers held by an agency be kept exempt from

1 public disclosure because such numbers are of a sensitive and
2 personal nature. Public disclosure of such numbers could
3 create the opportunity for theft or fraud, thereby
4 jeopardizing the financial safety of an individual.
5 Additionally, revealing such numbers could interfere with an
6 individual's willingness to pay a financial debt owed to an
7 agency due to the lack of protective measures securing the
8 release of such numbers through a public-records request.
9 Section 3. Paragraph (z) of subsection (3) of section
10 119.07, Florida Statutes, as amended by section 1 of chapter
11 2001-364, Laws of Florida, is repealed.
12 Section 4. This act shall take effect upon becoming a
13 law.

16 SENATE SUMMARY
17 Exempts bank account numbers and debit, charge, and
credit card numbers held by a state agency from
18 disclosure under the public-records law. Repeals an
exemption from the public-records law provided for bank
19 account numbers or debit, charge, or credit card numbers
given to a state agency for purposes of payment of a fee
20 or debt.
