18 (a) Property used in connection with a violation
19 resulting in a conviction for the illegal taking, or attempted
20 taking, sale, possession, or transportation of saltwater
21 products is subject to seizure and forfeiture as part of the
22 commission's efforts to protect the state's marine life.
23 Saltwater products and seines, nets, boats, motors, other
24 fishing devices or equipment, and vehicles or other means of
25 transportation used or attempted to be used in connection
26 with, as an instrumentality of, or in aiding and abetting such
27 illegal taking or attempted taking are hereby declared to be
28 nuisances.
29 (b) Upon a conviction of a person in whose possession
30 the property was found, the court having jurisdiction over the
31 criminal offense, notwithstanding any jurisdictional

1 limitations on the amount in controversy, may make a finding
2 that the property was used in connection with a saltwater
3 products violation and may order such property forfeited to
4 the commission.
5 (c) For purposes of this section, a conviction, except
6 with respect to a first time offender under this chapter for
7 whom adjudication is withheld, is any disposition other than
8 acquittal or dismissal.
