15 Remove everything after the resolving clause

17 and insert:
18 That the amendment to Section 4 of Article VI and the
19 creation of Section 26 of Article XII of the State
20 Constitution set forth below are agreed to and shall be
21 submitted to the electors of Florida for approval or rejection
22 at the general election to be held in November 2002:
23 ARTICLE VI
24 SUFFRAGE AND ELECTIONS
25 SECTION 4. Disqualifications.--
26 (a) No person convicted of a felony, or adjudicated in
27 this or any other state to be mentally incompetent, shall be
28 qualified to vote or hold office until restoration of civil
29 rights or removal of disability.
30 (b) No person may appear on the ballot for re-election
31 to any of the following offices:

1 (1) Florida representative,
2 (2) Florida senator,
3 (3) Florida Lieutenant governor, or
4 (4) any office of the Florida cabinet,
5 (5) U.S. Representative from Florida, or
6 (6) U.S. Senator from Florida

8 if, by the end of the current term of office, the person will
9 have served (or, but for resignation, would have served) in
10 that office for twelve eight consecutive years.
11 ARTICLE XII
12 SCHEDULE
13 SECTION 26. Term limits.--The amendment to Section 4
14 of Article VI denying ballot access for re-election to the
15 lieutenant governor or any cabinet officer or state legislator
16 who will have served (or, but for resignation, would have
17 served) in that office for 12 consecutive years, rather than 8
18 consecutive years, shall take effect upon approval by the
19 voters and shall apply only to those officers whose
20 consecutive years in office begin in November 2002 or
21 thereafter.
22 BE IT FURTHER RESOLVED that in accordance with the
23 requirements of section 101.161, Florida Statutes, the title
24 and substance of the amendment proposed herein shall appear on
25 the ballot as follows:
26 TERM LIMITS
27 Increases, from 8 to 12, the number of consecutive
28 years a state legislator, the Lieutenant Governor, or any
29 Cabinet officer may serve in that office before being denied
30 the right to have his or her name appear on the ballot for
31 re-election to that office. Applies to those officers whose

1 consecutive years in office begin in November 2002 or
2 thereafter. Removes provisions that apply term limits by
3 means of ballot access to members of Congress, which the
4 United States Supreme Court has determined violate the Federal
5 Constitution.

14 A joint resolution proposing an amendment to
15 Section 4 of Article VI and the creation of
16 Section 26 of Article XII of the State
17 Constitution, relating to limitations on the
18 number of consecutive years during which
19 certain elected constitutional officers may
20 hold office before being denied the right to
21 have their names appear on the ballot.
