2 An act relating to architecture and interior
3 design; amending s. 455.32, F.S.; revising the
4 Management Privatization Act to delegate
5 certain responsibilities of the Department of
6 Business and Professional Regulation to the
7 Board of Architecture and Interior Design and
8 require the board to contract for the provision
9 of certain services; granting the board access
10 to certain funds; requiring the board to submit
11 an annual budget request to fund its delegated
12 responsibilities as a separately itemized part
13 of the department's annual legislative budget
14 request; providing an effective date.

16 Be It Enacted by the Legislature of the State of Florida:

18 Section 1. Subsection (13) of section 455.32, Florida
19 Statutes, is amended to read:
20 455.32 Management Privatization Act.--
21 (13)(a) The duties and authority of the department to
22 investigate and discipline persons licensed under part I of
23 chapter 481, to issue subpoenas and citations and retain legal
24 counsel, investigators, and prosecutorial staff in connection
25 with the practice of architecture and interior design, and to
26 investigate and deter the unlicensed practice of architecture
27 or interior design as provided in this chapter are delegated
28 to the Board of Architecture and Interior Design, created
29 under part I of chapter 481 and referred to elsewhere in this
30 subsection as the "board."

1 (b) The board, in lieu of the department, shall
2 contract with a corporation or other business entity pursuant
3 to subsection (3) to provide investigative, legal counsel, and
4 prosecutorial services and any other services necessary to
5 perform these duties. The corporation or business entity
6 shall comply with all requirements of this section and shall
7 report directly to the board in lieu of the department.
8 (c) The board may utilize funds in the profession's
9 unlicensed activity account established pursuant to s.
10 455.2281 to perform its duties under s. 455.228.
11 (d) The board shall submit an annual budget request to
12 fund its activities under this subsection, which shall be
13 separately itemized in the legislative budget request
14 submitted by the department. No later than October 1, 2000,
15 the department shall contract with a corporation in accordance
16 with subsection (3) for the provision of services for
17 architects and interior designers.
18 Section 2. This act shall take effect upon becoming a
19 law.

Revises the Management Privatization Act to delegate
24 responsibilities of the Department of Business and
Professional Regulation relating to investigation,
25 discipline, prosecution, and unlicensed activity to the
Board of Architecture and Interior Design and to require
26 the board to contract with a corporation or other
business entity for certain of those services. Grants
27 the board access to the profession's unlicensed activity
account to perform its duties related thereto. Requires
28 the board to submit an annual budget request to fund its
delegated responsibilities as a separately itemized part
29 of the department's annual legislative budget request.
