1 A bill to be entitled
2 An act relating to tobacco; prohibiting the
3 sale, offer for sale, or display of tobacco
4 products under specified circumstances;
5 providing exceptions; providing a penalty;
6 providing an effective date.

8 Be It Enacted by the Legislature of the State of Florida:

10 Section 1. (1)(a) A person, business, tobacco
11 retailer, or other establishment, with the exception of a
12 package store as defined by general law, may not sell, offer
13 for sale, or display any single package of cigarettes as
14 defined by section 210.01, Florida Statutes, or smokeless
15 tobacco in an open display that is accessible to the public
16 without the intervention of the person or of an employee of
17 the person, business, tobacco retailer, or establishment.
18 (b) Paragraph (a) does not apply to a retail store
19 that derives at least 90 percent of its revenue from tobacco
20 and tobacco-related products or a store on the premises of
21 which persons under the age of 18 are not permitted.
22 (2) A person, business, tobacco retailer, or other
23 establishment may offer and sell cartons and multi-unit
24 packages of cigarettes as defined by section 210.01, Florida
25 Statutes, or smokeless tobacco through open displays only if
26 the displays are within the line of sight of the sales clerk,
27 in accordance with state law.
28 (3) A violation of this section constitutes a
29 misdemeanor of the second degree, punishable as provided in
30 section 775.082 or section 775.083, Florida Statutes.
31 Section 2. This act shall take effect July 1, 2002.

COMMITTEE SUBSTITUTE FOR

4 The committee substitute deletes the bill's restrictions on
display and sale of tobacco products and replaces them with
5 restrictions on cigarettes and smokeless tobacco. There are
exemptions from the single-package limitations for package
6 stores, retail stores that derive at least 90 percent of their
revenue from tobacco and tobacco-related products, and stores
7 in which minors are not permitted.
