  2         An act relating to health education; amending

  3         s. 233.0672, F.S.; authorizing school-based

  4         acquired immune deficiency syndrome education

  5         incentive grants; specifying grant proposal

  6         requirements; specifying factors to be

  7         considered in awarding grants; requiring annual

  8         reports; providing an appropriation; providing

  9         an effective date.

11  Be It Enacted by the Legislature of the State of Florida:

12

13         Section 1.  Subsection (3) is added to section

14  233.0672, Florida Statutes, to read:

15         233.0672  Health education; instruction in acquired

16  immune deficiency syndrome; incentive grants.--

17         (3)(a)  Beginning with the 2002-2003 school year, from

18  funds appropriated by the Legislature for this purpose, the

19  Department of Education is authorized and directed to award

20  grants on a competitive basis to public school districts

21  wishing to implement an acquired immune deficiency syndrome

22  education program pursuant to this subsection. Such grants

23  shall be awarded annually by no later than October 1 of each

24  year.

25         (b)  Each school district wishing to apply for a

26  school-based acquired immune deficiency syndrome education

27  incentive grant shall submit a grant proposal to the

28  department by August 1 of each year on forms prescribed by the

29  department.  In order to be considered for funding, the grant

30  proposal must include at least the following information and

31  assurances:

  1         1.  A detailed description of the program to be

  2  implemented, including a statement of program objectives and

  3  activities, target population, number of students to be

  4  served, and identification of all education, community agency,

  5  private sector, or other personnel and resources involved in

  6  program development and implementation.

  7         2.  Assurance that parents and guardians will be

  8  involved in the development and implementation of the program.

  9         3.  A detailed program budget.

10         4.  Measures for evaluation of the effectiveness of the

11  program, including outcomes.

12         (c)  The department shall consider the following

13  factors in awarding grants as specified in this subsection:

14         1.  The human immunodeficiency virus/acquired immune

15  deficiency syndrome, sexually transmitted disease, and teenage

16  pregnancy rates within the geographic area to be served by the

17  program.  Those geographic areas with high human

18  immunodeficiency virus/acquired immune deficiency syndrome,

19  sexually transmitted disease, and/or teenage pregnancy rates

20  shall have priority for selection.

21         2.  The qualifications and training of personnel who

22  will be responsible for program administration and classroom

23  implementation.

24         3.  The extent to which the program will be coordinated

25  with the existing school comprehensive health education

26  program.

27         4.  The potential outcome effectiveness of the program.

28         5.  The degree to which the program's objectives and

29  activities are consistent with the goals of this subsection.

30         (d)  The department shall make available to any school

31  district wishing to apply for a school-based acquired immune

  1  deficiency syndrome education incentive grant information on

  2  all of the criteria to be used by the department in the

  3  selection of the proposals for funding pursuant to the

  4  provisions of this subsection.

  5         (e)  Each school district that is awarded a grant

  6  pursuant to the provisions of this subsection shall submit an

  7  annual report to the department documenting the extent to

  8  which the program objectives are being met.

  9         Section 2.  The sum of $3.5 million is appropriated

10  from the General Revenue Fund to the Department of Education

11  for the purpose of implementing this act.

12         Section 3.  This act shall take effect July 1, 2002.

15                       LEGISLATIVE SUMMARY

16    With respect to health education in the public schools,
      authorizes the award of school-based acquired immune
17    deficiency syndrome education incentive grants.  Provides
      requirements for school district grant proposals and
18    factors to be considered in awarding grants and
      appropriating $3.5 million to implement the act.
