15 On page 8, between lines 4 and 5,

17 insert:
18 Section 5. Effective January 7, 2005, all powers,
19 duties, functions, rules, records, personnel, property, and
20 unexpended balances of appropriations, allocations, or other
21 funds of the Correctional Privatization Commission, as created
22 in chapter 957, Florida Statutes, are transferred to the
23 office of the chief financial officer by a type one transfer,
24 as defined in section 20.06(2), Florida Statutes.
25 Section 6. Subsection (1), paragraph (e) of subsection
26 (3), and subsection (6) of section 957.03, Florida Statutes,
27 are amended to read:
28 957.03 Correctional Privatization Commission.--
29 (1) COMMISSION.--The Correctional Privatization
30 Commission is created within the office of the chief financial
31 officer for the purpose of entering into contracts with

1 contractors for the designing, financing, acquiring, leasing,
2 constructing, and operating of private correctional
3 facilities. For administrative purposes, the commission is
4 created within the Department of Management Services. The
5 commission may enter into contracts with contractors for the
6 designing, financing, acquiring, leasing, and constructing of
7 private juvenile commitment facilities.
8 (3) TERMS, ORGANIZATION, AND MEETINGS.--
9 (e) The commission may employ an executive director,
10 subject to approval or dismissal by the chief financial
11 officer, and such staff as is necessary, within the limits of
12 legislative appropriation. The commission may retain such
13 consultants as it deems necessary to accomplish its mission.
14 Neither the executive director nor any consultant retained by
15 the commission may have been an employee or a contract vendor
16 of or a consultant to the department or the Department of
17 Juvenile Justice, or an employee or a contract vendor of or a
18 consultant to a bidder, for 2 years prior to employment with
19 the commission and may not become an employee or a contract
20 vendor of or a consultant to the department or the Department
21 of Juvenile Justice, or an employee or a contract vendor of or
22 a consultant to a bidder, for 2 years following termination of
23 employment with the commission.
24 (6) OFFICE OF THE CHIEF FINANCIAL OFFICER SUPPORT BY
25 DEPARTMENT OF MANAGEMENT SERVICES.--The commission shall be a
26 separate budget entity, and the executive director shall be
27 its chief administrative officer. The office of the chief
28 financial officer Department of Management Services shall
29 provide administrative support, oversight, and service to the
30 commission to the extent requested by the executive director.
31 The commission and its staff are not subject to control,

1 supervision, or direction by the Department of Management
2 Services in any manner, including, but not limited to,
3 personnel, purchasing, and budgetary matters, except to the
4 extent as provided in chapters 110, 216, 255, 282, and 287 for
5 agencies of the executive branch. The executive director may
6 designate a maximum of two policymaking or managerial
7 positions as being exempt from the Career Service System.
8 These two positions may be provided for as members of the
9 Senior Management Service.
