2 An act relating to home medical equipment
3 providers; amending s. 400.925, F.S.;
4 eliminating the regulation of certain home
5 medical equipment by the Agency for Health Care
6 Administration; providing an effective date.

8 Be It Enacted by the Legislature of the State of Florida:

10 Section 1. Subsection (8) of section 400.925, Florida
11 Statutes, is amended to read:
12 400.925 Definitions.--As used in this part, the term:
13 (8) "Home medical equipment" includes any product as
14 defined by the Federal Drug Administration's Drugs, Devices
15 and Cosmetics Act, any products reimbursed under the Medicare
16 Part B Durable Medical Equipment benefits, or any products
17 reimbursed under the Florida Medicaid durable medical
18 equipment program. Home medical equipment includes, but is not
19 limited to, oxygen and related respiratory equipment; manual,
20 motorized, or. Home medical equipment includes customized
21 wheelchairs and related seating and positioning, but does not
22 include prosthetics or orthotics or any splints, braces, or
23 aids custom fabricated by a licensed health care
24 practitioner;. Home medical equipment includes assistive
25 technology devices, including: manual wheelchairs, motorized
26 wheelchairs, motorized scooters;, voice-synthesized computer
27 modules, optical scanners, talking software, braille printers,
28 environmental control devices for use by person with
29 quadriplegia, motor vehicle adaptive transportation aids,
30 devices that enable persons with severe speech disabilities to
31 in effect speak, personal transfer systems; and specialty

1 beds, including demonstrator, for use by a person with a
2 medical need.
3 Section 2. This act shall take effect July 1, 2002.
