1 A bill to be entitled
2 An act relating to prescription drug claim
3 identification cards; creating s. 627.6465,
4 F.S.; providing intent; requiring certain
5 licensed insurers to provide a benefits
6 identification card for certain purposes under
7 certain circumstances; providing an exception;
8 specifying required information; providing for
9 temporary stickers for annual renewal cards;
10 providing an effective date.

12 Be It Enacted by the Legislature of the State of Florida:
13
14 Section 1. Section 627.6465, Florida Statutes, is
15 created to read:
16 627.6465 Identification cards for processing
17 prescription drug claims.--
18 (1) The intent of this section is to improve patient
19 care by minimizing confusion, eliminating unnecessary work,
20 decreasing patient wait time, and improving business
21 efficiencies.
22 (2) Any entity licensed or authorized under the
23 Florida Insurance Code, as defined in s. 624.01, and any
24 entity that provides similar insurance benefits under a
25 government funded or government mandated program, that enters
26 into an agreement to provide insurance coverage, payments, or
27 a prescription drug card for outpatient prescription drugs
28 shall provide a benefits identification card that contains
29 sufficient information to allow for prescription claims
30 processing. Any entity that provides a health benefits
31 identification card that contains all of the information

1 needed to process outpatient prescription drug claims as
2 required by this section shall not be required to provide a
3 separate prescription drug identification drug card.
4 (a) The benefits identification card shall contain the
5 following information necessary to process prescription drug
6 claims in a manner that makes such information readily
7 identifiable or, alternatively, such information may be
8 embedded in the card and available through magnetic stripe,
9 smart card, or other electronic technology:
10 1. The name of the claim processor.
11 2. The issuer identification number, also referred to
12 as the Banking Identification Number or "BIN," assigned by the
13 American National Standards Institute unless instruction is
14 provided on the card for ready access to such number by
15 electronic means.
16 3. The insured's prescription group number.
17 4. The insured's identification number.
18 5. The insured's name.
19 6. The claims submission name and address.
20 7. The help desk telephone number.
21 8. Any other information that the entity finds will
22 assist in the processing of the claim.
23 (b) A benefits identification card required under
24 paragraph (a) shall be issued not later than 60 days after any
25 change in the information contained on the card becomes
26 effective. If an entity subject to this section issues annual
27 renewal cards, it may issue a temporary sticker containing the
28 new information in lieu of issuing a new card prior to the
29 annual renewal date. Such sticker shall be designed so that
30 it can be attached to the existing card.
31 Section 2. This act shall take effect October 1, 2002.
