  1                      A bill to be entitled

  2         An act relating to the rental car surcharge;

  3         amending s. 212.0606, F.S.; requiring proceeds

  4         from the surcharge in the State Transportation

  5         Trust Fund be used to fund the County Incentive

  6         Grant Program in the Department of

  7         Transportation; providing an effective date.

  8

  9  Be It Enacted by the Legislature of the State of Florida:

10

11         Section 1.  Subsection (2) of section 212.0606, Florida

12  Statutes, is amended to read:

13         212.0606  Rental car surcharge.--

14         (2)(a)  Notwithstanding the provisions of section

15  212.20, and less costs of administration, 80 percent of the

16  proceeds of this surcharge shall be deposited in the State

17  Transportation Trust Fund, 15.75 percent of the proceeds of

18  this surcharge shall be deposited in the Tourism Promotional

19  Trust Fund created in s. 288.122, and 4.25 percent of the

20  proceeds of this surcharge shall be deposited in the Florida

21  International Trade and Promotion Trust Fund. For the purposes

22  of this subsection, "proceeds" of the surcharge means all

23  funds collected and received by the department under this

24  section, including interest and penalties on delinquent

25  surcharges.

26         (b)  Notwithstanding any other provision of law, the

27  proceeds deposited in the State Transportation Trust Fund

28  shall be budgeted on an annual basis in the Department of

29  Transportation's work program to each department district,

30  except the Turnpike District. The amount budgeted for each

31  district shall be based upon the amount of proceeds collected

  1  in the counties within each respective district. The district

  2  allocations shall be used exclusively to fund the County

  3  Incentive Grant Program for that district as provided in s.

  4  339.2817.

  5         Section 2.  This act shall take effect upon becoming a

  6  law.
