  1                      A bill to be entitled

  2         An act relating to private security officers;

  3         establishing an advisory committee; providing

  4         for its membership and responsibilities;

  5         providing an appropriation; providing an

  6         effective date.

  7

  8  Be It Enacted by the Legislature of the State of Florida:

  9

10         Section 1.  (1)  A committee is created under the

11  leadership of the Secretary of State for the purpose of

12  recommending minimum qualifications and training standards for

13  a new class of private security officer specializing in

14  terrorism prevention. The committee shall be composed of 15

15  members, 7 of whom are to be appointed by the Governor, 3 of

16  whom are to be appointed by the President of the Senate, and 3

17  of whom are to be appointed by the Speaker of the House of

18  Representatives. In addition, the Chief Health Officer of the

19  state shall serve as a member, and the Secretary of State or

20  his or her designee shall serve as the chairperson of the

21  committee. Committee appointments shall be made as follows:

22         (a)  The Governor shall appoint a representative from

23  the Florida Department of Law Enforcement; a representative

24  from the Department of Community Affairs, Division of

25  Emergency Management Services; a representative from the

26  Florida National Guard; a representative from the University

27  of South Florida Center for Biological Defense; a

28  representative from the Florida Sheriffs Association; and two

29  representatives from companies that currently provide

30  contra-terrorism training and services.

  1         (b)  The President of the Senate shall appoint a

  2  representative from the Association of Private Sector

  3  Security; a representative from the Florida Fire Chiefs

  4  Association; and a representative from a company that

  5  currently provides contra-terrorism training and services.

  6         (c)  The Speaker of the House of Representatives shall

  7  appoint a representative from the Florida Association of

  8  Firefighters; a representative from the Florida Police Chiefs

  9  Association; and a representative from a company that

10  currently provides contra-terrorism training and services.

12  The appointments must be made by July 1, 2002, and the

13  committee shall hold its first meeting by August 1, 2002. Any

14  vacancy occurring in the membership of the committee is to be

15  filled in the same manner as the original appointment.

16         (2)  Each member of the committee is entitled to one

17  vote, and action of the committee is not binding unless taken

18  by a majority vote of the entire membership of the committee.

19         (3)  The committee shall provide recommendations to:

20         (a)  Establish different types of private security

21  officers who specialize in the prevention of terrorism.

22         (b)  Establish certification requirements for each type

23  of private security officer who specializes in the prevention

24  of terrorism;

25         (c)  Identify those facilities that will benefit from

26  the protection of private security officer who specialize in

27  the prevention of terrorism;

28         (d)  Determine the appropriate type of private security

29  officer to protect each typy of facility from terrorism;

  1         (e)  Determine the necessary length of time to

  2  implement a certification program for private security

  3  officers who specialize in the prevention of terrorism; and

  4         (f)  Establish penalties for failure to comply with the

  5  certification program contemplated by this act.

  7  The committee may provide any other recommendations it

  8  considers appropriate, and may seek the advice of federal

  9  agencies.

10         (4)  The committee shall, by December 1, 2002, provide

11  to the President of the Senate, the Speaker of the House of

12  Representatives, and the Governor a written report containing

13  its specific recommendations, including its legislative

14  recommendations.

15         (5)  Committee members shall receive no compensation

16  for their services, but members other than public officers and

17  employees shall be entitled to be reimbursed by the Department

18  of State for per diem and travel expenses as provided in

19  chapter 112, Florida Statutes. Public officers and employees

20  shall be reimbursed by their respective agencies as provided

21  in chapter 112, Florida Statutes.

22         (6)  All agencies under the control of the Governor are

23  directed, and all other agencies are requested, to render

24  assistance and cooperation to the committee.

25         (7)  The committee shall continue in existence until

26  its objectives are achieved, but not later than December 31,

27  2002.

28         Section 2.  The sum of $36,000 is appropriated from the

29  General Revenue Fund to the Department of State to administer

30  the provisions of this act.

  1         Section 3.  This act shall take effect upon becoming a

  2  law.

  6    Establishes an advisory committee to make recommendations
      concerning private security officers. Prescribes its
  7    membership and duties. Appropriates $36,000 to fund the
      committee.
