  1                      A bill to be entitled

  2         An act relating to assault; amending s. 901.15,

  3         F.S.; authorizing a law enforcement officer to

  4         make an arrest without a warrant when there is

  5         probable cause to believe that the person has

  6         committed assault upon a law enforcement

  7         officer, a firefighter, an emergency medical

  8         care provider, public transit employees or

  9         agents, or certain other officers or has

10         committed assault or battery upon any employee

11         of a receiving facility; providing an effective

12         date.

14  Be It Enacted by the Legislature of the State of Florida:

16         Section 1.  Subsection (16) is added to section 901.15,

17  Florida Statutes, to read:

18         901.15  When arrest by officer without warrant is

19  lawful.--A law enforcement officer may arrest a person without

20  a warrant when:

21         (16)  There is probable cause to believe that the

22  person has committed assault upon a law enforcement officer, a

23  firefighter, an emergency medical care provider, public

24  transit employees or agents, or other specified officers as

25  set forth in s. 784.07 or has committed assault or battery

26  upon any employee of a receiving facility as defined in s.

27  394.455 who is engaged in the lawful performance of his or her

28  duties.

29         Section 2.  This act shall take effect July 1, 2002.
