1 A bill to be entitled
2 An act relating to electronic access to public
3 records; amending s. 28.2221, F.S.; requiring
4 each county recorder to ensure that social
5 security numbers, financial account numbers,
6 and the names and addresses of minors are
7 concealed from official records and information
8 made available to the public through the
9 Internet; providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Section 28.2221, Florida Statutes, is
14 amended to read:
15 28.2221 Electronic access to official records.--
16 (1) The Legislature finds that a proper and legitimate
17 state purpose is served by providing the public with access to
18 public records and information on the Internet and hereby
19 determines that the provisions of this section fulfill and
20 further an important state interest.
21 (2) No later than January 1, 2002, the county recorder
22 in each county shall provide a current index of documents
23 recorded in the official records of the county for the period
24 beginning no later than January 1, 1990, on a publicly
25 available Internet website that which shall also contain a
26 document requisition point for obtaining images or copies of
27 the documents reflected in the index and which has the
28 capability of electronically providing the index data to a
29 central statewide search site.
30 (3) Each county recorder shall use appropriate
31 Internet security measures to ensure that a no person has the

1 ability to alter or to modify any public record cannot be
2 altered or modified.
3 (4) Unless otherwise provided by law, no information
4 retrieved electronically pursuant to this section may not
5 shall be admitted admissible in court as an authenticated
6 document.
7 (5) By January 1, 2006, each county recorder shall
8 provide for electronic retrieval, at a minimum, of images of
9 documents referenced as the index required to be maintained on
10 the county's official records website by this section.
11 (6) In order to protect the public from the theft of
12 personal identification information, each county recorder
13 shall use the most practical means available to conceal from
14 each copy of records made available through the Internet any
15 social security number, financial account number, or name and
16 address of a minor.
17 Section 2. This act shall take effect upon becoming a
18 law.
