3 minority and woman-owned business contracting;
4 amending s. 373.607, F.S.; authorizing the
5 South Florida Water Management District to
6 provide financial incentives to prime
7 contractors who increase participation of
8 minority and woman-owned businesses as
9 subcontractors; providing a definition;
10 providing for contract criteria; providing an
11 appropriation; providing an effective date.

13 Be It Enacted by the Legislature of the State of Florida:

15 Section 1. Section 373.607, Florida Statutes, is
16 amended to read:
17 373.607 Minority business enterprise procurement
18 goals; implementation of recommendations.--
19 (1) Each water management district, as created in this
20 chapter, may implement the recommendations from any study
21 conducted pursuant to chapter 91-162, Laws of Florida, to
22 achieve minority business enterprise procurement goals.
23 (2) To assist the South Florida Water Management
24 District in increasing participation of locally owned minority
25 and woman-owned businesses at the subcontractor level, the
26 South Florida Water Management District is authorized to
27 provide financial incentives to prime contractors who
28 successfully increase the utilization of such businesses under
29 their contracts. For purposes of this section, "locally owned"
30 means businesses owned, located, and operated in an area
31 geographically close to where the work pursuant to the

1 contract will be performed. Such financial incentives shall be
2 payable to the prime contractor only upon successful
3 completion of the contract and after meeting criteria
4 established by the South Florida Water Management District
5 documenting that minority and woman-owned business
6 participation in such contract was increased as a result of
7 greater efforts and involvement by the prime contractor to
8 obtain such participation. The South Florida Water Management
9 District may develop specific criteria and guidelines for each
10 contract.
11 Section 2. There is hereby appropriated the sum of $2
12 million dollars from the General Revenue Fund to the South
13 Florida Water Management District to implement provisions of
14 this act.
15 Section 3. This act shall take effect July 1, 2002.

Authorizes the South Florida Water Management District to

21 subcontractors. Defines "locally owned." Authorizes the
water management district to develop criteria for
