16  and insert:  
17         Section 1.  Section 256.15, Florida Statutes, is
18  created to read:
19         256.15  Display of U.S. flag; prohibition unlawful;
20  penalty.--
21         (1)  It is unlawful for any person to prohibit:
22         (a)  The display of a portable, removable flag of the
23  United States that is less than 3 feet by 5 feet, or
24         (b)  The display of the flag of the United States that
25  is less than 3 feet by 5 feet by means of a portable,
26  removable flag pole that is no higher than 13 feet and no
27  greater than 6 inches in diameter.

29  This section shall not apply if the display of the flag of the
30  United States constitutes a threat to the health, safety or
31  welfare of any person or interferes with the operation of a

 1  business, religious, or educational institution or if such
 2  display violates a municipal or county ordinance.
 3         (2)  A violation of this section constitutes a
 4  noncriminal violation. The first violation shall be punished
 5  by fine in an amount not to exceed $500. A second or
 6  subsequent violation shall be punished by fine in an amount
 7  not to exceed $10,000.
 8         Section 2.  This act applies retroactively regardless
 9  of any declaration rules or requirements of homeowners'
10  association dealing with flags or decorations.
