  2         An act relating to local transportation

  3         facility improvement projects; amending s.

  4         339.2817, F.S., relating to the County

  5         Incentive Grant Program within the Department

  6         of Transportation; providing procedure for

  7         application by a municipality; providing for

  8         project oversight authority and responsibility;

  9         providing an effective date.

11  Be It Enacted by the Legislature of the State of Florida:

12  

13         Section 1.  Subsection (6) of section 339.2817, Florida

14  Statutes, is amended to read:

15         339.2817  County Incentive Grant Program.--

16         (6)  A municipality may apply to the county in which

17  the municipality is located for consideration by the county

18  for funding under this section of any project or project phase

19  of a transportation facility which is located on the State

20  Highway System or which is demonstrated to relieve congestion

21  on the State Highway System. The county must evaluate all

22  municipal applications as provided in subsection (3). If the

23  proposed project is determined by the county to meet the

24  criteria in subsection (3), the county shall send the

25  application to the department on behalf of the municipality.

26  If the proposed project is then approved by the department,

27  the county may retain project oversight authority and

28  responsibility or delegate such oversight authority and

29  responsibility to the applicant. If a municipality's proposed

30  project is rejected by the county for funding under this

31  section, or if the county's proposed project adversely affects

  1  a municipality within the county, the municipality may request

  2  mediation to resolve any concerns of the municipality and the

  3  county.

  4         Section 2.  This act shall take effect upon becoming a

  5  law.

      Revises provisions relating to application by a
10    municipality for grants from the County Incentive Grant
      Program within the Department of Transportation. Requires
11    the county to determine the application's compliance with
      certain criteria prior to submitting it to the
12    department. Provides that, upon approval by the
      department, the county may retain oversight authority and
13    responsibility for the project or delegate that authority
      and responsibility to the applicant.
