1 A bill to be entitled
2 An act relating to civil penalties; amending s.
3 318.21, F.S.; authorizing use of civil
4 penalties to fund local law enforcement
5 automation under certain circumstances;
6 providing an effective date.

8 Be It Enacted by the Legislature of the State of Florida:

10 Section 1. Subsection (9) of section 318.21, Florida
11 Statutes, as amended by chapter 2001-122, Laws of Florida, is
12 amended to read:
13 318.21 Disposition of civil penalties by county
14 courts.--All civil penalties received by a county court
15 pursuant to the provisions of this chapter shall be
16 distributed and paid monthly as follows:
17 (9) Twelve dollars and fifty cents from each moving
18 traffic violation must be used by the county to fund that
19 county's participation in an intergovernmental radio
20 communication program approved by the Department of Management
21 Services. If the county is not participating in such a program
22 or if a municipality within the county maintains a radio
23 communication program independent of the county, funds
24 collected within the territorial jurisdiction of the
25 municipality may must be used to fund local law enforcement
26 automation and must be distributed to the municipality or
27 special improvement district in which the violation occurred
28 or to the county if the violation occurred within the
29 unincorporated area of the county.
30 Section 2. This act shall take effect July 1, 2002.
