  1                      A bill to be entitled

  2         An act relating to corrections; amending s.

  3         944.02, F.S.; redefining the term "prisoner"

  4         for purposes of the state corrections code;

  5         providing penalties; providing an effective

  6         date.

  8  Be It Enacted by the Legislature of the State of Florida:

10         Section 1.  Subsection (6) of section 944.02, Florida

11  Statutes, is amended to read:

12         944.02  Definitions.--The following words and phrases

13  used in this chapter shall, unless the context clearly

14  indicates otherwise, have the following meanings:

15         (6)  "Prisoner" means any person who is under arrest

16  and in the lawful custody of any law enforcement official, or

17  any person convicted and sentenced by any court and committed

18  to any municipal or county jail or state prison, prison farm,

19  or penitentiary, or to the custody of the department pursuant

20  to lawful authority, as provided by law.

21         Section 2.  This act shall take effect July 1, 2002.

24                          SENATE SUMMARY

25    Redefines the term "prisoner," for purposes of the state
      corrections code, to include any person lawfully
26    committed to a correctional facility.
