17 Section 1. Paragraphs (c), (d), and (f) of subsection
18 (9) of section 550.6305, Florida Statutes, are amended to
19 read:
20 550.6305 Intertrack wagering; guest track payments;
21 accounting rules.--
22 (9) A host track that has contracted with an
23 out-of-state horse track to broadcast live races conducted at
24 such out-of-state horse track pursuant to s. 550.3551(5) may
25 broadcast such out-of-state races to any guest track and
26 accept wagers thereon in the same manner as is provided in s.
27 550.3551.
28 (b) Notwithstanding the provisions of subsection (1)
29 and s. 550.625(1) and (2)(a), the distribution of the net
30 proceeds that are retained by a thoroughbred host track from
31 the takeout on an out-of-state race rebroadcast under this

1 subsection shall be as follows:
2 1. One-third of the remainder of such proceeds shall
3 be paid to the guest track;
4 2. One-third of the remainder of such proceeds shall
5 be retained by the host track; and
6 3. One-third of the remainder of such proceeds shall
7 be paid by the host track as purses at the host track.
8 (c) All guest tracks other than thoroughbred
9 permitholders that are eligible to receive wagers on
10 out-of-state horseraces rebroadcast from a host track racing
11 under a thoroughbred horse permit shall be subject to the
12 distribution of the net proceeds as specified in paragraph (b)
13 or paragraph (d) (a) unless the host and guest permitholders
14 and the recognized horseman's group agree to a different
15 distribution of their respective portions of the proceeds by
16 contract.
17 (d) Any permitholder located in any county area of the
18 state where there are only two permits, one for dogracing and
19 one for jai alai, may accept wagers on rebroadcasts of
20 out-of-state thoroughbred horse races from an in-state
21 thoroughbred horse racing permitholder and shall not be
22 subject to the provisions of paragraph (b) if such
23 thoroughbred horse racing permitholder located within the area
24 specified in this paragraph is both conducting live races and
25 accepting wagers on out-of-state horseraces. In such case,
26 the guest permitholder shall be entitled to 45 percent of the
27 net proceeds on wagers accepted at the guest facility. The
28 remaining proceeds shall be distributed as follows: one-half
29 shall be retained by the host facility and one-half shall be
30 paid by the host facility as purses at the host facility.
31 (f) Any permitholder located in any county area of the

1 state where there are only two permits, one for dogracing and
2 one for jai alai, may accept wagers on rebroadcasts of
3 out-of-state harness horse races from an in-state harness
4 horse racing permitholder and shall not be subject to the
5 provisions of paragraph (e) (b) if such harness horse racing
6 permitholder located within the area specified in this
7 paragraph is conducting live races. In such case, the guest
8 permitholder shall be entitled to 45 percent of the net
9 proceeds on wagers accepted at the guest facility. The
10 remaining proceeds shall be distributed as follows: one-half
11 shall be retained by the host facility and one-half shall be
12 paid by the host facility as purses at the host facility.
13 Section 2. Paragraph (a) of subsection (7) of section
14 550.334, Florida Statutes, is amended to read:
15 550.334 Quarter horse racing; substitutions.--
16 (7)(a) Any quarter horse racing permitholder operating
17 under a valid permit issued prior to January 1, 2002, by the
18 division that has not been relocated after December 31, 2001,
19 to a county other than the county that appears on the original
20 permit application is authorized to substitute other races of
21 other breeds of horses which are, respectively, registered
22 with the American Paint Horse Association, Appaloosa Horse
23 Club, Arabian Horse Registry of America, Jockey Club, Palomino
24 Horse Breeders of America, or United States Trotting
25 Association, for no more than 50 percent of the quarter horse
26 races daily.
27 Section 3. (1) Notwithstanding the provisions of s.
28 550.01215(4), the license of thoroughbred horserace
29 permitholder who fails to operate all performances specified
30 on its license that are scheduled prior to July 1, 2004 will
31 not be subject to fine or suspension by the division.

1 (2) Notwithstanding the provisions of s.
2 550.09515(3)(a), a thoroughbred horse permitholder who does
3 not pay tax on handle for live thoroughbred performances
4 through the period ending July 1, 2004, does not abandon its
5 interest in its permit.
6 (3) Notwithstanding the provision of s. 550.5251(2),
7 though the period ending July 1, 2004, the ability to operate
8 horseracing meets the full number of days authorized on each
9 of the dates set forth in its license shall not be a condition
10 precedent to the validity of a thoroughbred racing
11 permitholder's license or permit.
12 Section 4. This act shall take effect upon becoming a
13 law.
