  1                      A bill to be entitled

  2         An act relating to enterprise zone designation;

  3         requiring designation of an enterprise zone in

  4         the City of Hialeah under certain circumstances

  5         notwithstanding certain limitations; providing

  6         requirements; prohibiting a racetrack or

  7         pari-mutuel facility from providing the basis

  8         for benefits or incentives due to its location

  9         within an enterprise zone; providing an

10         effective date.

12  Be It Enacted by the Legislature of the State of Florida:

14         Section 1.  Notwithstanding the limitation in section

15  290.0065, Florida Statutes, on numbers of enterprise zones

16  within a population category, the Office of Tourism, Trade,

17  and Economic Development shall designate, upon joint

18  application by Miami-Dade County and the City of Hialeah, an

19  area within the municipality of the City of Hialeah in an area

20  bounded by 32nd Street, 21st Street, Palm Avenue, and East 4th

21  Avenue as an enterprise zone. The application must be

22  submitted by June 1, 2002, and must comply with the

23  requirements of section 290.0055, Florida Statutes, except for

24  paragraph (4)(d). The effective date of the enterprise zone is

25  July 1, 2002.

26         Section 2.  Limitation of enterprise zone benefits and

27  incentives to pari-mutuels.--No person located in an area for

28  which a permit or license has been issued authorizing

29  pari-mutuel operations may receive benefits or incentives due

30  to the person's location within an enterprise zone.
