1 A bill to be entitled
2 An act relating to thoroughbred racing dates;
3 creating s. 550.5252, F.S.; revising racing
4 dates for certain permitholders; providing an
5 effective date.

7 Be It Enacted by the Legislature of the State of Florida:

9 Section 1. Section 550.5252, Florida Statutes, is
10 created to read:
11 550.5252 Thoroughbred racing; racing season.--
12 (1) To promote international tourism and economic
13 development through the continued conduct of thoroughbred
14 racing in this state and to promote the thoroughbred breeding
15 industry within the agricultural economy of the state, in any
16 area of the state in which there are three or more
17 thoroughbred permitholders, the annual thoroughbred racing
18 season, commencing June 1 and ending May 31, shall be divided
19 into three periods, as follows:
20 (a) First period....October 16 through January 31.
21 (b) Second period....February 1 through May 15.
22 (c) Third period....May 16 through October 15.
23 (2) The department shall assign said periods of
24 operation among the three such permitholders. However, no
25 permitholder may be assigned more than one period of operation
26 in any annual thoroughbred racing season.
27 (3) An application for a license to operate in such
28 periods must be received by the department by December 31, and
29 may, thereafter, be amended by March 31. The department shall
30 assign periods and issue a license to each applicant to

1 operate within the annual thoroughbred racing season by April
2 30.
3 (4) For the purpose of this section, any permitholder
4 who has more than 50 percent interest in another permitholder
5 shall be considered a single applicant. An applicant may apply
6 for only one period at its facility yearly. The department
7 shall allocate the periods if more than one applicant applies
8 for the same period in any given year. If the same two
9 applicants apply for the same period in 2 consecutive years,
10 they shall be assigned different periods than those assigned
11 in the previous year.
12 Section 2. This act shall take effect upon becoming a
13 law.
