3 amending s. 445.009, F.S.; directing Workforce
4 Florida, Inc., to develop strategies and
5 policies for using private-sector staffing
6 services firms; requiring a report; providing
7 an effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Subsection (10) of section 445.009, Florida
12 Statutes, is amended to read:
13 445.009 One-stop delivery system.--
14 (10) Notwithstanding any other provision of law,
15 Workforce Florida, Inc., shall develop strategies and policies
16 for incorporating the use of private-sector staffing services
17 firms into the operation of the state's workforce system in
18 order to reduce duplication in the delivery of workforce
19 services to individuals and employers. Workforce Florida,
20 Inc., shall incorporate provisions relating to the use of such
21 staffing services firms into the strategic plan required under
22 s. 445.006. In addition, Workforce Florida, Inc., shall
23 develop policies and guidelines for use by the regional
24 workforce boards in fulfilling the ability of the boards to
25 use private-sector staffing services firms to the maximum
26 extent feasible in the one-stop delivery system, pursuant to
27 subsection (9). In developing the strategies, policies, and
28 guidelines under this section, Workforce Florida, Inc., shall
29 consider the extent to which the use of private-sector
30 staffing services firms could result in more efficient
31 delivery of workforce services, including, but not limited to,

1 the extent to which portions of the one-stop delivery system
2 or specific activities of the one-stop delivery system could
3 be reduced, augmented, or replaced by activities conducted by
4 such staffing services firms. By January 1, 2003, Workforce
5 Florida, Inc., in conjunction with local workforce boards and
6 the staffing services industry, shall submit a report to the
7 Governor, the President of the Senate, and the Speaker of the
8 House of Representatives on its progress in fulfilling the
9 requirements and on additional options for the state to
10 increase the use of private-sector staffing services firms in
11 the workforce system. The reports shall also include
12 recommendations on whether the membership of the board of
13 Workforce Florida, Inc., and the regional workforce boards
14 should be amended to include representatives from staffing
15 services firms. To the maximum extent feasible, the one-stop
16 delivery system may use private sector staffing services firms
17 in the provision of workforce services to individuals and
18 employers in the state. Regional workforce boards may
19 collaborate with staffing services firms in order to
20 facilitate the provision of workforce services. Regional
21 workforce boards may contract with private sector staffing
22 services firms to design programs that meet the employment
23 needs of the region. All such contracts must be
24 performance-based and require a specific period of job tenure
25 prior to payment.
26 Section 2. This act shall take effect upon becoming a
27 law.
