3 amending s. 445.009, F.S.; directing Workforce
4 Florida, Inc., to develop strategies and
5 policies for using private-sector staffing
6 services firms; requiring a report; providing
7 requirements for certain contracts; providing
8 an effective date.

10 Be It Enacted by the Legislature of the State of Florida:

12 Section 1. Subsection (10) of section 445.009, Florida
13 Statutes, is amended to read:
14 445.009 One-stop delivery system.--
15 (10) Notwithstanding any other provision of law,
16 Workforce Florida, Inc., shall develop strategies and policies
17 for incorporating the use of private-sector staffing services
18 firms into the operation of the state's workforce system in
19 order to reduce duplication in the delivery of workforce
20 services to individuals and employers. Workforce Florida,
21 Inc., shall incorporate provisions relating to the use of such
22 staffing services firms into the strategic plan required under
23 s. 445.006. In addition, Workforce Florida, Inc., shall
24 develop policies and guidelines for use by the regional
25 workforce boards in fulfilling the ability of the boards to
26 use private-sector staffing services firms to the maximum
27 extent feasible in the one-stop delivery system, pursuant to
28 subsection (9). In developing the strategies, policies, and
29 guidelines under this section, Workforce Florida, Inc., shall
30 consider the extent to which the use of private-sector
31 staffing services firms could result in more efficient

1 delivery of workforce services, including, but not limited to,
2 the extent to which portions of the one-stop delivery system
3 or specific activities of the one-stop delivery system could
4 be reduced, augmented, or replaced by activities conducted by
5 such staffing services firms. By January 1, 2003, Workforce
6 Florida, Inc., in conjunction with local workforce boards and
7 the staffing services industry, shall submit a report to the
8 Governor, the President of the Senate, and the Speaker of the
9 House of Representatives on its progress in fulfilling the
10 requirements and on additional options for the state to
11 increase the use of private-sector staffing services firms in
12 the workforce system. The report shall also include
13 recommendations on whether the membership of the regional
14 workforce boards should be changed to include representatives
15 from staffing services firms and whether additional
16 representatives from staffing services firms should be added
17 to the board of directors of Workforce Florida, Inc. Any
18 contract between a regional workforce board and a
19 private-sector staffing services firm must be
20 performance-based and must require a specific period of job
21 tenure prior to payment. To the maximum extent feasible, the
22 one-stop delivery system may use private sector staffing
23 services firms in the provision of workforce services to
24 individuals and employers in the state. Regional workforce
25 boards may collaborate with staffing services firms in order
26 to facilitate the provision of workforce services. Regional
27 workforce boards may contract with private sector staffing
28 services firms to design programs that meet the employment
29 needs of the region. All such contracts must be
30 performance-based and require a specific period of job tenure
31 prior to payment.

7 The committee substitute requires contracts between regional
workforce boards and private-sector staffing services firms to
8 be performance-based and provide a specific period of job
tenure prior to payment. The committee substitute also
9 clarifies that a report must include recommendations on
whether additional representatives of staffing services firms
10 should be added to the board of directors of Workforce
Florida, Inc.
