1 A bill to be entitled
2 An act relating to supportive housing;
3 directing the Secretary of Children and Family
4 Services and the Secretary of Health Care
5 Administration to establish a workgroup to
6 review issues related to, and to improve,
7 consumer protection in state-funded supportive
8 housing; providing for membership and staff of
9 the workgroup; requiring legislative
10 recommendations; requiring a report; providing
11 an effective date.

13 Be It Enacted by the Legislature of the State of Florida:

15 Section 1. The Secretary of Children and Family
16 Services and the Secretary of Health Care Administration shall
17 establish a workgroup for the purposes of reviewing issues
18 associated with consumer protection in state-funded supportive
19 housing and developing legislative recommendations to improve
20 consumer protection for consumers of state-funded mental
21 health services who reside in state-funded supportive housing
22 living arrangements. The workgroup objectives are limited to
23 the development of a licensure requirement, annual surveys to
24 determine appropriateness of placement, and the imposition of
25 a consumer bill of rights tied to a civil liability statute.
26 The Secretary of Children and Family Services and the
27 Secretary of Health Care Administration shall each appoint an
28 equal number of representatives from their respective
29 departments and an equal number of representatives from the
30 Florida Health Care Association, the Florida Assisted Living
31 Affiliation, the Florida Association of Homes for the Aging,

1 the Florida Council for Behavioral Healthcare, Inc., the
2 National Alliance for the Mentally Ill, and the Advocacy
3 Center for Persons with Disabilities, Inc. The workgroup shall
4 be staffed by representatives from the Department of Children
5 and Family Services and the Agency for Health Care
6 Administration. Each member of the workgroup shall serve at
7 his or her own expense. The workgroup shall prepare
8 recommendations no later than January 1, 2003, and provide a
9 copy to the Governor, the President of the Senate, and the
10 Speaker of the House of Representatives.
11 Section 2. This act shall take effect upon becoming a
12 law.

15 LEGISLATIVE SUMMARY

Directs the Secretary of Children and Family Services and
17 the Secretary of Health Care Administration to establish
a workgroup to review issues associated with consumer
18 protection in state-funded supportive housing and develop
recommendations to improve consumer protection for
19 consumers of mental health services who reside in such
housing. Legislative recommendations must be reported to
20 the Governor and Legislature by January 1, 2003.
