  1                      A bill to be entitled

  2         An act relating to campaign financing; amending

  3         s. 106.09, F.S.; increasing penalties for

  4         making or accepting certain illegal campaign

  5         contributions; providing an effective date.

  7  Be It Enacted by the Legislature of the State of Florida:

  8

  9         Section 1.  Section 106.09, Florida Statutes, is

10  amended to read:

11         106.09  Cash contributions and contribution by

12  cashier's checks.--

13         (1)  A No person may not shall make or accept a cash

14  contribution or contribution by means of a cashier's check in

15  excess of $100.

16         (2)(a)  Any person who makes or accepts a contribution

17  in excess of $100 in violation of this section commits is

18  guilty of a misdemeanor of the first degree, punishable as

19  provided in s. 775.082 or s. 775.083.

20         (b)  Any person who knowingly and willfully makes or

21  accepts a contribution in excess of $5,000 in violation of

22  this section commits a felony of the third degree, punishable

23  as provided in s. 775.082, s. 775.083, or s. 775.084.

24         Section 2.  This act shall take effect July 1, 2002.

27                          SENATE SUMMARY

28    Provides that knowingly and willfully making or accepting
      a contribution in cash or by means of a cashier's check
29    in excess of $5,000 constitutes a third-degree felony.
      Retains the first-degree-misdemeanor penalty for making
30    or accepting a contribution in cash or by means of a
      cashier's check in excess of $100, whether or not the act
31    was done knowingly and willfully.
