  1                      A bill to be entitled

  2         An act relating to the Florida Building

  3         Commission; requiring the commission to develop

  4         building code provisions to facilitate the

  5         rehabilitation and use of existing structures;

  6         requiring the commission to identify

  7         legislative changes required to implement such

  8         code provisions; requiring a report to the

  9         Legislature; providing an effective date.

11  Be It Enacted by the Legislature of the State of Florida:

12  

13         Section 1.  (1)  The Legislature directs the Florida

14  Building Commission to develop building code provisions that

15  may be added to the Florida Building Code to facilitate the

16  rehabilitation and use of existing structures. The commission

17  shall select from available national or international model

18  codes or the codes or code provisions adopted by another state

19  to form the foundation for the code provisions required by

20  this section.

21         (2)  The commission shall seek consensus with fire

22  safety professionals, advocates for persons with disabilities,

23  representatives of the construction industry, land-use

24  planners, building officials, and others identified by the

25  commission as having an interest in building code provisions.

26  The commission may modify the selected model codes and

27  standards as needed to accommodate the specific needs of this

28  state.

29         (3)  In conjunction with its code development

30  activities, the commission shall identify legislative changes

  1  required to implement the code provisions developed pursuant

  2  to subsections (1) and (2).

  3         (4)  The commission shall report the activities

  4  undertaken in response to the requirements of this act to the

  5  Legislature on or before January 1, 2003, as a part of the

  6  annual report required by s. 553.77(1)(b), Florida Statutes.

  7  Recommended code provisions and the legislative changes

  8  required for implementation shall be attached as appendices to

  9  the annual report.

10         Section 2.  This act shall take effect upon becoming a

11  law.
