  1                      A bill to be entitled

  2         An act relating to farm labor contractors;

  3         amending s. 450.34, F.S.; prohibiting the

  4         charging of certain fees to farm laborers;

  5         providing an effective date.

  7  Be It Enacted by the Legislature of the State of Florida:

  8

  9         Section 1.  Section 450.34, Florida Statutes, is

10  amended to read:

11         450.34  Prohibited acts of farm labor contractor.--A No

12  licensee may not shall:

13         (1)  Make any misrepresentation or false statement in

14  his or her application for a certificate of registration.

15         (2)  Make or cause to be made to any person any false,

16  fraudulent, or misleading representation or publish or

17  circulate or cause to be published or circulated any false,

18  fraudulent, or misleading information concerning the terms,

19  conditions, or existence of employment at any place or places,

20  by any person or persons, or of any individual or individuals.

21         (3)  Make any charge or deduction from wages for any

22  tools, equipment, transportation, or recruiting fees that are

23  determined under the federal Fair Labor Standards Act to be to

24  the benefit of the employer.

25         Section 2.  This act shall take effect July 1, 2002.

  1          STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
                       COMMITTEE SUBSTITUTE FOR
  2                         Senate Bill 168

  4  Committee Substitute for Senate Bill 168 is different from
    Senate Bill 168 in that it:
  5

  6       Spells out that the specified charges which cannot be
    deducted from a farm worker's wages are to be determined in
  7  accordance with the federal Fair Labor Standards Act.
