18         (4)  The department shall biannually review the

19  official state lists of invasive plants and noxious weeds as

20  provided for under this chapter and department rules. The

21  plants listed in section 369.251 on March 1, 2002, shall be

22  incorporated into the departments lists as provided for under

23  this chapter. All local government ordinances listing invasive

24  plants or noxious weeds prior to March 1, 2002, shall remain

25  in affect. A water management district when identifying by

26  rule pursuant to 373.185, or a local government when

27  identifying by ordinance a list of noxious weeds, invasive

28  plants, or plants deemed to be a public nuisance or threat,

29  shall utilize the lists developed under this chapter or rules

30  adopted thereunder.
