18 (4) The department, in conjunction with the Institute
19 of Food and Agricultural Sciences at the University of
20 Florida, shall biennially review the official state lists of
21 noxious weeds and invasive plants as provided for under this
22 chapter and department rules. The plants listed in section
23 369.251 shall be incorporated into the department lists as
24 provided for under this chapter. A water management district
25 when identifying by rule pursuant to section 373.185, or a
26 local government when identifying by ordinance or regulation
27 adopted on or after March 1, 2002, a list of noxious weeds,
28 invasive plants, or plants deemed to be a public nuisance or
29 threat, shall only adopt the lists developed under this
30 chapter or rules adopted thereunder. All local government
31 ordinances or regulations adopted prior to March 1, 2002, that

1 list noxious weeds or invasive plants shall remain in effect.
2 All local ordinances or regulations requiring the removal of
3 invasive plants or noxious weeds from publicly or privately
4 owned conservation areas or preserves shall be exempt from the
5 limitations in this subsection.
