8 annual carryforward of funds; providing for
9 future legislative review and termination or
10 re-creation of the trust fund; providing an
11 effective date.

13 Be It Enacted by the Legislature of the State of Florida:

15 Section 1. Section 250.176, Florida Statutes, is
16 created to read:
17 250.176 Emergency Response Trust Fund.--
18 (1) The Emergency Response Trust Fund is created
19 within the Department of Military Affairs.
20 (2) Funds to be credited to the trust fund shall
21 consist of reimbursements from the Federal Emergency
22 Management Agency for the costs of activating the Florida
23 National Guard and transfers of state funds approved by budget
24 amendments processed as provided in chapter 216. Such funds
25 shall be used to pay all operational costs incurred by the
26 Florida National Guard when called to active duty.
27 (3)(a) The trust fund is exempt from the service
28 charges imposed by s. 215.20.
29 (b) Notwithstanding s. 216.301 and pursuant to s.
30 216.351, any balance in the trust fund at the end of the

1 fiscal year shall remain in the trust fund and shall be
2 available for carrying out the purposes of the trust fund.
3 (4) In accordance with s. 19(f)(2), Art. III of the
4 State Constitution, the Emergency Response Trust Fund shall,
5 unless terminated sooner, be terminated on July 1, 2006.
6 Before its scheduled termination, the trust fund shall be
7 reviewed as provided in s. 215.3206.
8 Section 2. This act shall take effect July 1, 2002.

11 LEGISLATIVE SUMMARY

Creates the Emergency Response Trust Fund within the
