2 An act relating to political advertisements;
3 creating s. 106.072, F.S.; requiring certain
4 persons that make expenditures for political
5 advertisements to report information with
6 respect thereto; providing penalties; providing
7 applicability; providing an effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Section 106.072, Florida Statutes, is
12 created to read:
13 106.072 Disclosure of certain advertisements.--Any
14 person that makes or commits to make an expenditure for a
15 political advertisement that names or refers to a candidate
16 and that is published or broadcast 60 days or less before the
17 election in which the named candidate is running, which person
18 is not otherwise required to report such expenditures or
19 advertisements, must disclose the expenditure, the source of
20 funds used, and the recipient of the funds. Disclosure must be
21 made to the office with which the candidate named or
22 referred-to is required to file reports of contributions under
23 s. 106.07. If the person making the expenditure is a natural
24 person or an entity that is not otherwise required to register
25 with the division, the person must designate an individual
26 responsible for maintaining records necessary to comply with
27 this section and for filing the disclosure required by this
28 section. The disclosure must be filed no later than 10 days
29 before the election. A person who fails to file a disclosure
30 required by this section is subject to the same penalty as is
31 prescribed for violation of s. 106.07.

1 Section 2. This act applies to advertisements that
2 name or refer to a candidate in an election that occurs at
3 least 60 days after the effective date of this act.
4 Section 3. This act shall take effect July 1, 2002.

7 SENATE SUMMARY
8 Requires persons not otherwise required to disclose
political advertisements to report advertisements made 60
9 days or less before an election which name or refer to a
candidate running in that election. The report is to be
10 made with the office with which the candidate files
contribution reports and must include the amount of the
11 expenditure and the source and recipient of the funds.
Failure is subject to the same penalty as for failure of
12 a candidate to file a required report.
