13         Amendment (with title amendment) 

14  Remove:  everything after the enacting clause,

15

16  and insert:

17         Section 1.  Section 285.16, Florida Statutes, is

18  amended to read:

19         285.16  Civil and criminal jurisdiction; Indian

20  reservation; exception.--

21         (1)  The State of Florida hereby assumes jurisdiction

22  over criminal offenses committed by or against Indians or

23  other persons within Indian reservations and over civil causes

24  of actions between Indians or other persons or to which

25  Indians or other persons are parties rising within Indian

26  reservations.

27         (2)  The civil and criminal laws of Florida shall

28  obtain on all Indian reservations in this state and shall be

29  enforced in the same manner as elsewhere throughout the state.

30         (3)  Upon consent of the Secretary of Interior to this

31  retrocession of jurisdiction, subsections (1) and (2) of this

  1  section shall not apply to criminal offenses committed by an

  2  enrolled member of the Miccosukee Tribe of Indians of Florida,

  3  or a person eligible for such enrollment, against the person

  4  or property of any other such enrolled member or person

  5  eligible for such enrollment within the Indian reservations of

  6  the Miccosukee Tribe of Indians of Florida.

  7         Section 2.  This act shall take effect upon becoming a

  8  law.

13  Remove:  the entire title,

15  and insert:

16                      A bill to be entitled

17         An act relating to Indian reservations;

18         amending s. 285.16, F.S.; specifying that the

19         state's jurisdiction over criminal offenses

20         committed within Indian reservations does not

21         apply to Indian reservations of the Miccosukee

22         Tribe of Indians of Florida; providing an

23         exception for such reservations with respect to

24         the applicability of criminal laws of the

25         state; providing an effective date.
