1 A bill to be entitled
2 An act relating to Indian reservations;
3 amending s. 285.16, F.S.; providing that the
4 state shall not have jurisdiction over crimes
5 by one Miccosukee committed against the person
6 or property of another Miccosukee within the
7 reservations of the Miccosukee Tribe of Indians
8 of Florida; providing an effective date.

10 Be It Enacted by the Legislature of the State of Florida:

12 Section 1. Section 285.16, Florida Statutes, is
13 amended to read:
14 285.16 Civil and criminal jurisdiction; Indian
15 reservation; exception.--
16 (1) The State of Florida hereby assumes jurisdiction
17 over criminal offenses committed by or against Indians or
18 other persons within Indian reservations and over civil causes
19 of actions between Indians or other persons or to which
20 Indians or other persons are parties rising within Indian
21 reservations.
22 (2) The civil and criminal laws of Florida shall
23 obtain on all Indian reservations in this state and shall be
24 enforced in the same manner as elsewhere throughout the state.
25 (3) Upon consent of the Secretary of Interior to this
26 retrocession of jurisdiction, subsections (1) and (2) of this
27 section shall not apply to criminal offenses committed by an
28 enrolled member of the Miccosukee Tribe of Indians of Florida,
29 or a person eligible for such enrollment, against the person
30 or property of any other such enrolled member or person

1 eligible for such enrollment within the Indian reservations of
2 the Miccosukee Tribe of Indians of Florida.
3 Section 2. This act shall take effect upon becoming a
4 law.
