11  Senator Laurent moved the following amendment:

13         Senate Amendment (with title amendment) 

14         On page 2, between lines 30 and 31,

15

16  insert:

17         Section 2.  Subsection (4) is added to section 581.091,

18  Florida Statutes, to read:

19         581.091  Noxious weeds and infected plants or regulated

20  articles; sale or distribution; receipt; information to

21  department; withholding information.--

22         (4)  The department, in conjunction with the Institute

23  of Food and Agricultural Sciences at the University of

24  Florida, shall biennially review the official state lists of

25  invasive plants and noxious weeds as provided for under this

26  chapter and department rules. The plants listed in s. 369.251

27  shall be incorporated into the department lists as provided

28  for under this chapter. A water management district when

29  identifying by rule pursuant to s. 373.185, or a local

30  government when identifying by ordinance, a list of noxious

31  weeds, invasive plants, or plants deemed to be a public

  1  nuisance or threat shall only adopt the lists developed under

  2  this chapter or rules adopted under this chapter. All local

  3  government ordinances adopted prior to March 1, 2002, which

  4  list noxious weeds or invasive plants shall remain in effect.

10  And the title is amended as follows:

11         On page 1, line 10, after the semicolon,

13  insert:

14         amending s. 581.091, F.S.; requiring the

15         Department of Agriculture and Consumer Services

16         to periodically review the state lists of

17         invasive plants and noxious weeds; requiring

18         water management districts and local

19         governments to use the lists when identifying

20         noxious weeds and certain other plants pursuant

21         to rule or ordinance;
