1 A bill to be entitled
2 An act relating to sale of alcoholic beverages
3 to minors; amending s. 768.125, F.S.; revising
4 criteria with respect to liability for injury
5 or damage for sale of alcoholic beverages to
6 certain persons; providing an effective date.

8 Be It Enacted by the Legislature of the State of Florida:

10 Section 1. Section 768.125, Florida Statutes, is
11 amended to read:
12 768.125 Liability for injury or damage resulting from
13 intoxication.--A person who sells or furnishes alcoholic
14 beverages to a person of lawful drinking age shall not thereby
15 become liable for injury or damage caused by or resulting from
16 the intoxication of such person, except that a person who, by
17 failing to request and check one of the forms of
18 identification listed in s. 562.11(1)(b), willfully and
19 unlawfully sells or furnishes alcoholic beverages to a person
20 who is not of lawful drinking age or who knowingly serves a
21 person habitually addicted to the use of any or all alcoholic
22 beverages may become liable for injury or damage caused by or
23 resulting from the intoxication of such minor or person.
24 Section 2. This act shall take effect upon becoming a
25 law.

Revises a provision of law with respect to liability for
4 the sale of alcoholic beverages to a person who is not of
lawful drinking age to eliminate the willful and unlawful
5 sale of such beverages and to provide for the failure to
request and check certain forms of identification to
6 confirm the age of the person to whom the beverages are
sold.
