11  Senator Silver moved the following amendment:

13         Senate Amendment (with title amendment) 

14         On page 2, between lines 13 and 14,

15

16  insert:

17         Section 2.  Subsection (9) is added to section 290.007,

18  Florida Statutes, to read:

19         290.007  State incentives available in enterprise

20  zones.--The following incentives are provided by the state to

21  encourage the revitalization of enterprise zones:

22         (9)(a)  Notwithstanding any law to the contrary, a

23  target industry business, as defined in s. 288.106 which

24  relocates within the same county into an enterprise zone as a

25  fee simple owner or as a tenant with a minimum initial term of

26  10 years is a "qualified target industry business" and a "new

27  business" as those terms are defined in s. 288.106 and is

28  eligible for the tax refund program for qualified target

29  industry businesses provided under s. 288.106 if:

30         1.  The target industry business creates a minimum of

31  500 jobs, as defined in s. 288.106, in the enterprise zone

  1  within 3 years after the date the business is certified as a

  2  qualified target industry business; and

  3         2.  Each job created in the enterprise zone by the

  4  business is a net new job.

  5         (b)  Not more than one target industry business within

  6  the county may participate in the tax-refund program for

  7  qualified target industry businesses at any one time. In

  8  reviewing and evaluating applications for approval under this

  9  subsection, the Office of Tourism, Trade, and Economic

10  Development shall consider, in the following order of

11  priority, how the state's resources are leveraged, as

12  applicable, in federal empowerment zones, federal enterprise

13  communities, and Front Porch Florida Communities.

22  insert:

27         eligibility; providing that no more than one

28         business is eligible at any one time;
