  1                      A bill to be entitled

  2         An act relating to enterprise zones; amending

  3         s. 290.0065, F.S.; authorizing certain

  4         additional counties to apply to the Office of

  5         Tourism, Trade, and Economic Development to

  6         amend the boundaries of certain enterprise

  7         zones or communities for certain purposes;

  8         providing an effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11

12         Section 1.  Subsection (9) of section 290.0065, Florida

13  Statutes, is amended to read:

14         290.0065  State designation of enterprise zones.--

15         (9)(a)  Before December 31, 2002 1998, the governing

16  body of a county in which an enterprise zone designated

17  pursuant to paragraph (5)(b) is located may apply to the

18  Office of Tourism, Trade, and Economic Development to amend

19  the boundaries of the enterprise zone for the purpose of

20  replacing areas not suitable for development.

21         (b)  Before December 31, 2002, the governing body of a

22  county in which an enterprise zone designated pursuant to

23  subparagraph (3)(a)2. is located may apply to the Office of

24  Tourism, Trade, and Economic Development to amend the

25  boundaries of the enterprise zone for the purpose of replacing

26  areas not suitable for development.

28  The Office of Tourism, Trade, and Economic Development shall

29  approve the application if it does not increase the overall

30  size of the enterprise zone.  Except that upon the request of

31  the governing body of a home rule charter county, or any

  1  county the government of which has been consolidated with the

  2  government of one or more municipalities in accordance with s.

  3  9, Art. VIII of the State Constitution of 1885, as preserved

  4  by s. 6(e), Art. VIII of the State Constitution as revised in

  5  1968 and subsequently amended, the Office of Tourism, Trade,

  6  and Economic Development may amend the boundaries of an area

  7  designated as an enterprise zone upon the receipt of a

  8  resolution adopted by such governing body describing the

  9  amended boundaries, so long as the added area does not

10  increase the overall size of the expanded zone more than its

11  original size or 20 square miles, whichever is larger, and is

12  consistent with the categories, criteria, and limitations

13  imposed by s. 290.0055.

14         Section 2.  This act shall take effect upon becoming a

15  law.
