3 s. 290.0065, F.S.; authorizing certain
4 additional counties to apply to the Office of
5 Tourism, Trade, and Economic Development to
6 amend the boundaries of certain enterprise
7 zones or communities for certain purposes;
8 amending s. 290.00675, F.S.; revising the
9 criteria for the Office of Tourism, Trade, and
10 Economic Development to amend the boundaries of
11 certain enterprise zones; providing an
12 effective date.

14 Be It Enacted by the Legislature of the State of Florida:

16 Section 1. Subsection (9) of section 290.0065, Florida
17 Statutes, is amended to read:
18 290.0065 State designation of enterprise zones.--
19 (9)(a) Before December 31, 2002 1998, the governing
20 body of a county in which an enterprise zone designated
21 pursuant to paragraph (5)(b) is located may apply to the
22 Office of Tourism, Trade, and Economic Development to amend
23 the boundaries of the enterprise zone for the purpose of
24 replacing areas not suitable for development.
25 (b) Before December 31, 2002, the governing body of a
26 county in which an enterprise zone designated pursuant to
27 subparagraph (3)(a)2. is located may apply to the Office of
28 Tourism, Trade, and Economic Development to amend the
29 boundaries of the enterprise zone for the purpose of replacing
30 areas not suitable for development.

1 The Office of Tourism, Trade, and Economic Development shall
2 approve the application if it does not increase the overall
3 size of the enterprise zone. Except that upon the request of
4 the governing body of a home rule charter county, or any
5 county the government of which has been consolidated with the
6 government of one or more municipalities in accordance with s.
7 9, Art. VIII of the State Constitution of 1885, as preserved
8 by s. 6(e), Art. VIII of the State Constitution as revised in
9 1968 and subsequently amended, the Office of Tourism, Trade,
10 and Economic Development may amend the boundaries of an area
11 designated as an enterprise zone upon the receipt of a
12 resolution adopted by such governing body describing the
13 amended boundaries, so long as the added area does not
14 increase the overall size of the expanded zone more than its
15 original size or 20 square miles, whichever is larger, and is
16 consistent with the categories, criteria, and limitations
17 imposed by s. 290.0055.
18 Section 2. Section 290.00675, Florida Statutes, is
19 amended to read:
20 290.00675 Amendment of certain enterprise zone
21 boundaries.--Notwithstanding any other provisions of law, the
22 Office of Tourism, Trade, and Economic Development may amend
23 the boundaries of an area designated as an enterprise zone in
24 a community having a population of 235,000 persons but less
25 than 255,000 245,000, so long as the area does not increase
26 the overall size of the zone by greater than 50 25 acres and
27 the increased area is contiguous to the existing enterprise
28 zone. The amendment must also be consistent with the
29 limitations imposed by s. 290.0055 upon establishment of the
30 enterprise zone.
