  1                      A bill to be entitled

  2         An act relating to trust funds; amending s.

  3         215.22, F.S.; providing an exemption to service

  4         charges for the Florida Center for Nursing

  5         Trust Fund; creating s. 464.0198, F.S.;

  6         creating the Florida Center for Nursing Trust

  7         Fund; providing for sources of funds and

  8         purposes; providing for annual carryforward of

  9         funds; providing for future review and

10         termination or re-creation of the trust fund;

11         providing a contingent effective date.

13  Be It Enacted by the Legislature of the State of Florida:

14

15         Section 1.  Paragraph (x) is added to subsection (1) of

16  section 215.22, Florida Statutes, to read:

17         215.22  Certain income and certain trust funds

18  exempt.--

19         (1)  The following income of a revenue nature or the

20  following trust funds shall be exempt from the deduction

21  required by s. 215.20(1):

22         (x)  The Florida Center for Nursing Trust Fund.

23         Section 2.  Section 464.0198, Florida Statutes, is

24  created to read:

25         464.0198  Florida Center for Nursing Trust Fund.--

26         (1)  There is created the Florida Center for Nursing

27  Trust Fund to be administered by the Department of Health.

28  Funds provided pursuant to s. 464.0195(3) for the Florida

29  Center for Nursing shall be deposited into this trust fund.

30  Other funds from grants and donations, federal funds, or other

31  funds from other sources specified by law may be deposited

  1  into this trust fund and used for purposes of the Florida

  2  Center for Nursing. Moneys deposited into this trust fund

  3  shall be used as provided in s. 464.0195. The trust fund is

  4  exempt from the service charges imposed by s. 215.20.

  5         (2)  Notwithstanding the provisions of s. 216.301 and

  6  pursuant to s. 216.351, any balance in the trust fund at the

  7  end of any fiscal year shall remain in the trust fund at the

  8  end of the year and shall be available for carrying out the

  9  purposes of the trust fund.

10         (3)  In accordance with s. 19(f)(2), Art. III of the

11  State Constitution, the Florida Center for Nursing Trust Fund

12  shall, unless terminated sooner, be terminated on July 1,

13  2006. Before its scheduled termination, the trust fund shall

14  be reviewed as provided in s. 215.3206(1) and (2).

15         Section 3.  This act shall take effect July 1, 2002, if

16  SB 1808 or similar legislation is adopted in the same

17  legislative session or an extension thereof and becomes law.

22  The CS for SB 1806 exempts the Florida Center for Nursing
    Trust Fund from the service charges imposed on trust funds.
