    SB 184                                         First Engrossed



  1                      A bill to be entitled

  2         An act relating to high occupancy vehicle

  3         lanes; amending s. 316.0741, F.S.; allowing

  4         certain energy-saving vehicles to travel in

  5         such lanes, regardless of occupancy; providing

  6         for a decal and registration certificate;

  7         providing for a fee; providing rulemaking

  8         authority; providing an effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11

12         Section 1.  Subsections (4) and (5) are added to

13  section 316.0741, Florida Statutes, to read:

14         316.0741  High occupancy vehicle lanes.--

15         (4)  Notwithstanding any other provision of this

16  section, an inherently low-emission vehicle (ILEV) that is

17  certified and labeled in accordance with federal regulations

18  may be driven in an HOV lane at any time, regardless of its

19  occupancy. The department shall issue a decal and registration

20  certificate, to be renewed annually, reflecting the HOV lane

21  designation on inherently low-emission vehicles authorizing

22  such use. The department may charge a fee for the decals, at a

23  price not to exceed the costs of designing, producing, and

24  distributing each decal, or $5, whichever is less. The

25  proceeds from sale of the decals shall be deposited in the

26  Highway Safety Operating Trust Fund.

27         (5)  The department has specific authority to adopt

28  rules addressing the design, production, and distribution of

29  the decals described in subsection (4); the enforcement of

30  ILEV use of HOV lanes; and the purchase and renewal of such

31  decals.
