8 Affairs, the Agency for Health Care
9 Administration, and the Department of Community
10 Affairs; requiring a report; providing for
11 development of a private-public partnership to
12 facilitate the development of a facility in a
13 Front Porch Community; providing design
14 principles; providing for appointment of an
15 advisory group to guide the study and the
16 private-public partnership development effort;
17 providing for the advisory group's membership,
18 meetings, and staff support; providing for
19 termination of the advisory group; providing an
20 appropriation; providing an effective date.

22 Be It Enacted by the Legislature of the State of Florida:
23
24 Section 1. Legislative findings.--The Legislature
25 finds that many elderly persons face a multitude of chronic
26 health problems and need an integrated package of health,
27 personal care, and social services, which are often not
28 offered in any systematic way in their communities. The
29 Legislature finds that the model of long-term-care support
30 known as "assisted living" is a residential-care model that
31 combines rental apartment living with supportive services to

1 aid the frail elderly person in performing the activities of
2 daily living. The Legislature finds that assisted living
3 offers elderly persons services that may include personal
4 care, housekeeping, linen service, medication management, and
5 24-hour oversight. The Legislature also finds that purchasing
6 assisted-living services is often out of the reach of
7 low-income and moderate-income elderly persons and that
8 existing long-term-care services do not adequately meet the
9 needs of these persons. The Legislature finds that assisted
10 living can be a cost-effective option for meeting the needs of
11 frail elderly persons. The Legislature finds that in addition
12 to providing more options for residents, expanding
13 long-term-care options has positive economic impacts on
14 communities, as initial construction of new facilities and
15 renovation of existing buildings boost the local economy. The
16 Legislature finds that there are barriers to the development
17 of affordable assisted-living facilities to serve low-income
18 and moderate-income frail elderly persons, particularly in
19 urban, African-American communities, and that technical
20 expertise from various groups and disciplines must be brought
21 together to overcome these barriers.
22 Section 2. Affordable assisted-living services for
23 minority persons.--
24 (1) STUDY; REPORT.--The University of South Florida's
25 Policy Exchange Center on Aging, in consultation with the
26 Institute on Urban Policy and Commerce at Florida Agricultural
27 and Mechanical University shall study the adequacy and
28 availability of affordable assisted-living services to
29 minority persons in at least one Front Porch Community in at
30 least one of the following counties: Miami-Dade, Pinellas,
31 Orange, Hillsborough, Duval, and Leon. The Department of

1 Elderly Affairs, the Agency for Health Care Administration,
2 and the Department of Community Affairs shall provide access
3 to such reports, records, and data as are needed by the
4 institute to complete the study. The institute shall submit
5 its report to the President of the Senate, the Speaker of the
6 House of Representatives, and the majority and minority
7 leaders in each house of the Legislature by December 22, 2003.
8 (2) DEVELOPMENT OF AN AFFORDABLE ASSISTED-LIVING
9 FACILITY; PUBLIC-PRIVATE PARTNERSHIP.--The Policy Exchange
10 Center on Aging, the Institute, the Office of Urban
11 Opportunity, the agency, and the departments shall work
12 together to develop a public-private partnership to facilitate
13 the development and operation of an affordable assisted-living
14 facility in a Front Porch Community in one or more of the
15 following counties: Miami-Dade, Pinellas, Orange,
16 Hillsborough, Duval and Leon. Those entities and the
17 public-private partnership shall include at least the
18 following principles in their design:
19 (a) Accessibility for visually, cognitively, or
20 mobility impaired residents as a basic requirement for a
21 functional environment.
22 (b) A stimulating environment that is safe but
23 challenging.
24 (c) Accommodation for changes in visual, auditory, and
25 olfactory senses in the environment and design.
26 (d) Use of historical reference and solutions
27 influenced by local tradition to provide a sense of the
28 familiar and to enhance the resident's sense of continuity.
29 (3) ADVISORY GROUP.--The director of the Policy
30 Exchange Center on Aging, in consultation with the Institute
31 on Urban Policy and Commerce and the Selected Front Porch

1 Council, shall appoint an advisory group to assist and guide
2 the study and the public-private partnership development
3 effort. The advisory group shall terminate upon the submission
4 of the report required under subsection (1) to the
5 Legislature.
6 (a) The advisory group shall include at least the
7 following members:
8 1. A staff person of the Agency for Health Care
9 Administration, appointed by the Secretary of Health Care
10 Administration.
11 2. The Secretary of Health or the secretary's
12 designee.
13 3. The Secretary of Elderly Affairs or the secretary's
14 designee.
15 4. The Secretary of Community Affairs or the
16 secretary's designee.
17 5. The executive director of the Florida Housing
18 Finance Corporation, or the executive director's designee.
19 6. One member from the Florida State Medical
20 Association who has expertise in geriatric medicine.
21 7. One member from a private-sector investment
22 institution or organization.
23 8. One member from a professional trade organization
24 representing assisted-living facilities.
25 9. One member from a professional trade organization
26 representing affordable elderly housing facilities.
27 10. The Director of the Real Choice Partnership
28 Project in the office of the Americans with Disabilities
29 Working Group.
30 (b) The advisory group shall be appointed by September
31 1, 2002, and shall have its first meeting no later than

1 October 1, 2000. The advisory group shall meet at least three
2 times before submitting the report required under subsection
3 (1).
4 (c) The Policy Exchange Center on Aging shall provide
5 staff support for the advisory group and may reimburse travel
6 expenses for such staff in accordance with section 112.061,
7 Florida Statutes.
8 Section 3. There is appropriated to the University of
9 South Florida's Policy Exchange Center on Aging the sum of
10 $100,000 from the Front Porch Florida Initiative to fund the
11 study on affordable assisted-living services for minority
12 persons provided for in this act.
13 Section 4. This act shall take effect July 1, 2002.

15 STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
COMMITTEE SUBSTITUTE FOR
16 Senate Bill 1860

18 The Committee Substitute for SB 1860 requires the Policy
Exchange Center on Aging, in consultation with the Institute
19 on Urban Policy and Commerce, to study the adequacy and
availability of affordable assisted living services to
20 minority persons in at least one Front Porch community. The
Center and the Institute are to work together with state
21 agencies to develop a public-private partnership to facilitate
the development and operation of an affordable assisted living
22 facility in a Front Porch community in one or more of the
counties specified. The director of the Center, in
23 consultation with the director of the Institute and the
selected Front porch Council, is to appoint an advisory group
24 with specified members which terminates upon submission of the
required report. The bill appropriates $100,000 to the Center
25 from the Front Porch Florida Initiative to fund the study.
