2 An act relating to public records; amending s.
3 121.4501, F.S.; providing for an exception from
4 the public records laws of records identifying
5 program participants in the Public Employee
6 Optional Retirement Program or reflecting their
7 investment activities and providing for limited
8 confidentiality; providing a statement of
9 public necessity; providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Subsection (19) is added to section
14 121.4501, Florida Statutes, to read:
15 121.4501 Public Employee Optional Retirement
16 Program.--
17 (19) PARTICIPANT RECORDS.--All records which identify
18 individual participants in the Florida Retirement System and
19 their account activities are exempt from the provisions of s.
20 119.07(1) and s. 24(a), Art. I of the State Constitution, and
21 shall be confidential to the extent such records need not be
22 revealed in the administration of the Florida Retirement
23 System pursuant to this chapter or in connection with a legal
24 or administrative proceeding.
25 Section 2. The Legislature finds that the exemption
26 from pubic records requirements provided for in this act for
27 identifying individual participants in the Florida Retirement
28 System and their account activities within the Public Employee
29 Optional Retirement Program is a public necessity and that to
30 reveal such information would discourage participation in the
31 Public Employee Optional Retirement Program.

1 Section 3. This act shall take effect June 1, 2002.
