1 A bill to be entitled
2 An act relating to pollution control; amending
3 s. 403.71852, F.S.; directing the Department of
4 Environmental Protection to conduct a
5 comprehensive authoritative review of the
6 end-of-life electronics waste stream; providing
7 for a report and recommendations; providing an
8 effective date.

10 WHEREAS, television sets and computers are omnipresent
11 in modern society, and
12 WHEREAS, the numbers of unusable, worn-out, or rejected
13 television sets, computers, and other electronic equipment
14 will surely increase in our rapidly growing state, and
15 WHEREAS, the cathode ray tube found in every television
16 set and computer monitor is the most problematic material in
17 the end-of-life electronics waste stream because of its lead
18 content, and
19 WHEREAS, cathode ray tubes are estimated to be the
20 largest source of lead in the state's municipal solid waste
21 stream, just ahead of lead acid batteries, NOW, THEREFORE,
22
23 Be It Enacted by the Legislature of the State of Florida:
24
25 Section 1. Section 403.71852, Florida Statutes, is
26 amended to read:
27 403.71852 Collection of lead-containing products.--
28 (1) The Department of Environmental Protection is
29 directed to work with the Department of Management Services to
30 implement a pilot program to collect lead-containing products,
31 including end-of-life computers and other electronic equipment

1 from state and local agencies. Local governments are
2 encouraged to establish collection and recycling programs for
3 publicly and privately owned lead-containing products,
4 including end-of-life televisions, computers, and other
5 electronic products, through existing recycling and household
6 hazardous-waste-management programs.
7 (2) The Department of Environmental Protection shall
8 conduct a comprehensive authoritative review of the pilot
9 programs under this section and the recycling grant projects
10 under s. 403.71851. The review must include, but is not
11 limited to, the appropriateness of maintaining, extending, or
12 revising current programs and projects; the effectiveness of
13 current programs and projects; and alternative techniques and
14 strategies for managing end-of-life computers, television
15 sets, and other electronic equipment. The department shall
16 consult with persons knowledgeable about the regulatory
17 frameworks and recycling and reuse infrastructures for
18 electronic equipment throughout the world, including, but not
19 limited to local governments, other states, other countries,
20 electronic equipment manufacturers, and public and private
21 recycling and waste management organizations. The department
22 shall issue its report, recommendations, and proposed
23 legislative changes to the Governor, the President of the
24 Senate, and the Speaker of the House of Representatives by
25 January 1, 2003.
26 Section 2. This act shall take effect upon becoming a
27 law.
