  1                      A bill to be entitled

  2         An act relating to vital statistics; creating

  3         the "Infants Born Alive Protection Act";

  4         amending s. 382.002, F.S.; providing

  5         applicability of the definition of "live

  6         birth"; providing an effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

  9

10         Section 1.  This act may be cited as the "Infants Born

11  Alive Protection Act."

12         Section 2.  Subsection (9) of section 382.002, Florida

13  Statutes, is amended to read:

14         382.002  Definitions.--As used in this chapter, the

15  term:

16         (9)  "Live birth" means the complete expulsion or

17  extraction of a product of human conception from its mother,

18  irrespective of the duration of pregnancy, which, after such

19  expulsion, breathes or shows any other evidence of life such

20  as beating of the heart, pulsation of the umbilical cord, and

21  definite movement of the voluntary muscles, whether or not the

22  umbilical cord has been cut or the placenta is attached. This

23  definition shall apply whether the expulsion or extraction

24  occurs as a result of natural or induced labor, cesarean

25  section, or induced abortion.

26         Section 3.  This act shall take effect upon becoming a

27  law.
