  1                      A bill to be entitled

  2         An act relating to trust funds; re-creating the

  3         Excellent Teaching Program Trust Fund within

  4         the Department of Education without

  5         modification; carrying forward current balances

  6         and continuing current sources and uses

  7         thereof; amending s. 236.08107, F.S.; deleting

  8         a provision relating to termination and review

  9         of the trust fund, to conform; providing an

10         effective date.

12         WHEREAS, the Legislature wishes to extend the life of

13  the Excellent Teaching Program Trust Fund within the

14  Department of Education, which is otherwise scheduled to be

15  terminated pursuant to constitutional mandate, and

16         WHEREAS, the Legislature has reviewed the trust fund

17  before its scheduled termination date and has found that it

18  continues to meet an important public purpose, and

19         WHEREAS, the Legislature has found that existing public

20  policy concerning the trust fund sets adequate parameters for

21  its use, NOW, THEREFORE,

23  Be It Enacted by the Legislature of the State of Florida:

24

25         Section 1.  (1)  The Excellent Teaching Program Trust

26  Fund within the Department of Education, FLAIR number

27  48-2-206, which is to be terminated pursuant to Section 19(f),

28  Article III of the State Constitution on July 1, 2002, is

29  re-created.

  1         (2)  All current balances of the trust fund are carried

  2  forward, and all current sources and uses of the trust fund

  3  are continued.

  4         Section 2.  Section 236.08107, Florida Statutes, is

  5  amended to read:

  6         236.08107  Excellent Teaching Program Trust Fund.--

  7         (1)  The Excellent Teaching Program Trust Fund is

  8  created to be administered by the Department of Education.

  9  Funds must be credited to the trust fund as provided in

10  chapter 98-309, Laws of Florida, to be used for the purposes

11  set forth therein.

12         (2)  Pursuant to the provisions of s. 19(f)(2), Art.

13  III of the State Constitution, the Excellent Teaching Program

14  Trust Fund shall, unless terminated sooner, be terminated on

15  July 1, 2002. Prior to its scheduled termination, the trust

16  fund shall be reviewed as provided in s. 215.3206(1) and (2).

17         Section 3.  This act shall take effect July 1, 2002.
