11  Senator Silver moved the following amendment to amendment

14         Senate Amendment (with title amendment) 

15         On page 8, between lines 24 and 25,

16

17  insert:

18         Section 7.  In order to implement Specific

19  Appropriation 451N of the 2002-2003 General Appropriations Act

20  and notwithstanding the provisions of chapter 287, Florida

21  Statutes, to the contrary, the Department of Children and

22  Family Services may engage in direct negotiations and

23  noncompetitive procurement of a new provider for South Florida

24  State Hospital in the event that the department receives

25  notice that Atlantic Shores Healthcare, Inc., intends to

26  terminate its contract. If the department fails in its attempt

27  to procure a new provider within the first 75 days of the

28  required notice period, the department may submit a budget

29  amendment for the creation of sufficient positions to manage

30  and operate the hospital. Such amendment shall further

31  transfer the remaining budget in contracted professional

  1  services into the appropriate operating categories.

  2  Notwithstanding the provisions of chapter 216, Florida

  3  Statutes, to the contrary, this amendment shall be subject to

  4  approval by the Executive Office of the Governor only;

  5  however, the notice and review provisions set forth in section

  6  216.177, Florida Statutes, must be followed. This section

  7  expires July 1, 2003.
