18 Section 2. Effective upon this act becoming a law, in
19 order to implement section 2 of the 2002-2003 General
20 Appropriations Act, sections 29 and 30 of chapter 2001-170,
21 Laws of Florida, are amended to read:
22 Section 29. Effective July 1, 2003, the Department of
23 Education shall maximize the available federal indirect cost
24 allowed on all federal grants. Beginning with the 2003-2004
25 2002-2003 fiscal year, none of the funds received from
26 indirect cost allowance shall be expended by the department
27 without specific appropriation by the Legislature. Funds
28 received pursuant to s. 240.241, Florida Statutes, are
29 specifically exempt from this provision.
30 Section 30. Effective July 1, 2003 June 30, 2002,
31 section 229.8065, Florida Statutes, is repealed.

1 Section 3. Effective upon this act becoming a law, in
2 order to implement section 2 of the 2002-2003 General
3 Appropriations Act, subsection (2) of section 229.085, Florida
4 Statutes, as amended by section 31 of chapter 2001-170, Laws
5 of Florida, is amended to read:
6 229.085 Custody of educational funds.--
7 (2)(a) There is created in the Department of Education
8 the Projects, Contracts, and Grants Trust Fund. The personnel
9 employed to plan and administer grants or contracts for
10 specific projects shall be considered in time-limited
11 employment not to exceed the duration of the grant or until
12 completion of the project, whichever first occurs. Such
13 employees shall not acquire retention rights under the Career
14 Service System. Any employee holding permanent career service
15 status in a Department of Education position who is appointed
16 to a position under the Projects, Contracts, and Grants Trust
17 Fund shall retain such permanent status in the career service
18 position.
19 (b) If, in executing the terms of such grants or
20 contracts for specific projects, the employment of personnel
21 shall be required, such personnel shall not be subject to the
22 requirements of s. 216.262(1)(a). This paragraph expires July
23 1, 2003.
