11  Senators Brown-Waite and Cowin moved the following amendment:

13         Senate Amendment (with title amendment) 
14         On page 1, lines 17-30, delete those lines
15  
16  and insert:  
17         (g)1.  Notwithstanding any other provisions of this
18  section, any separate legal entity created under this section
19  other than a regional water supply authority created under s.
20  373.1962, the membership of which is limited to municipalities
21  and counties of the state, may acquire, own, construct,
22  improve, operate, and manage public facilities relating to a
23  governmental function or purpose, including, but not limited
24  to, wastewater facilities, water or alternative water supply
25  facilities, and water reuse facilities, which may serve
26  populations by providing wastewater facilities, water or
27  alternative water supply facilities, and water reuse
28  facilities within but not or outside the territorial limits of
29  the members of the entity, unless the governing body of the
30  county or municipality where the population to be served is
31  located grants the entity permission to provide service within

 1  the boundaries of that county or municipality and the county
 2  in which the facilities are located assumes rate-setting
 3  jurisdiction over the facilities or delegates such
 4  jurisdiction to the Florida Public Service Commission. This
 5  paragraph is remedial and procedural in application.
 6  Notwithstanding s. 367.171(7), Any separate legal entity
 7  created under this paragraph is not subject to commission
 8  jurisdiction and may not provide utility services within the
 9  service area of an existing utility system unless it has
10  received the consent of the utility. The entity
